48 Seconds. Terms and Conditions.

1.    The Promoter is Frucor Beverages Ltd of Auckland, New Zealand (the Promoter).All information in relation to this promotion forms part of these terms and conditions.
2.    The promotion runs from 0900 on 04/04/11 to 23:59 on 29/04/11
3.    To enter, simply recreate and film an original video (no longer than 48 seconds) of a famous movie scene using V products, and submit it to your YouTube profile. Only entries that have been uploaded to YouTube will be accepted. You must then submit the hyperlink to your original video to the Promoter via the submit link on the People’s Republic of V website located at http://vrepublic.co.nz/48-seconds/ no later than 23:59 on 29/04/11.
4.    By submitting an entry to You Tube you also consent for your film to be displayed on the V Energy NZ Facebook page for the public to vote on, in conjunction with the associated People’s Choice Awards Competition (from 18 April 2011 terms and conditions for the People’s Choice Awards Competition can be found here) .
5.    Entries will not be accepted from entrants who do not complete all of the mandatory fields in the Submit page.
6.    Entry is limited to New Zealand residents only, who are 16 years of age or over and who are members of the People’s Republic of V at the time of entry. (For details on how to join the People’s Republic of V please visit http://www.vrepublic.co.nz).
7.    You may submit as many entries as you like, provided that each entry is totally original and complies with all the terms and conditions of entry.
8.    Entering the promotion implies acceptance of the terms and conditions of entry.
9.    There is one Grand Prize to be won.  The Grand Prize will be awarded to the entrant whose 48 second film is deemed the best by the Promoter and any Judges it selects. The Grand Prize winner will be selected entirely at the discretion of the Promoter and any Judges it selects.
10.    The Grand Prize consists of: 1 x Apple Macbook Pro, 1 x Apple Final Cut Express 4.0, 1 x 42" Panasonic Plasma TV, One Year’s Supply of V (being approximately 16 cases of 250ml cans of V). If the Grand Prize winner chooses to enter the V 48HOURS 2011 competition their registration fee will be paid for, plus they will receive $1000 cash to go towards their V 48HOURS 2011entry.
11.    There are two Runners Up Prizes to be won.  The Runners Up Prizes will be awarded to the two best entries (after the Grand Prize winner) as selected entirely at the discretion of the Promoter and any Judges it selects.
12.    The First Runner Up Prize consist of: 1 x  Panasonic HD Camcorder HDC-HS60GN-K, One Year Supply of V (being approximately 16 cases of 250ml cans of V). If the First Runner Up Prize winner chooses to enter the V 48 HOURS 2011 competition their registration fee will be paid for, plus they will receive $500 cash to go towards their V 48HOURS 2011 entry.
13.    The Second Runner Up Prize is a “V Super Pack” which consists of: selected tickets to V related events from 1 May 2011 – 30 April 2012 (the number of tickets and events to be determined entirely by the Promoter), One Year Supply of V (being approximately 16 cases of 250ml cans of V). If the Second Runner Up Prize winner chooses to enter the V 48HOURS 2011 competition their registration fee will be paid for, plus they will receive $250 cash to go towards their V 48HOURS 2011 entry .
14.    There will be five Special Prizes. The Special prizes will be awarded to the five entrants  who the Promoter and any Judges it selects, chooses.
15.    People’s Choice Awards Competition (from 18 April 2011 terms and conditions for the People’s Choice Awards Competition can be found by clicking here).
16.    The Special Prizes Prize consist of: One Year Supply of V (being approximately 16 cases of 250ml cans of V).
17.    Only entries complying with these terms and conditions will be judged.
18.    The Grand Prize winner, Runners Up Prize winners and Special Prize winners will be announced on 04/05/11.  The winners will be notified by telephone and/or email to the contact details supplied in the Submit page.
19.    A prize winner may opt to collect their prize from Auckland or have it couriered to them within New Zealand. If a prize winner elects to collect their prize from Auckland costs and expenses incurred in collecting the prize (including but not limited to any travel costs to and from Auckland and any accommodation expenses) will be the responsibility of the winner. If a prize winner elects to have their prize couriered this will be at the expense of Frucor.
20.    The Grand Prize winner, Runners Up Prize winners and Special Prize winners will also have their 48 Second film considered for incorporation into media banners on You Tube. as part of a media campaign . The Promoter reserves the right in its sole discretion to decide not to incorporate any or all of the winning films into media banners on You Tube.
21.    Prizes will be awarded to the person whose details are provided on the Submit page for the corresponding entry.  The Promoter takes no responsibility for disputes arising as a result of entries submitted by entrants using contact details (physical address, telephone number, mobile number and email address) belonging to another person, whether that person assisted in the making of the entry or not, or claims made by participants in the film making process who are not listed as the entrant.
22.    Registrations and entries enclosing partial information, submitted by or through fraud or other illegal activity, or entries not complying with these terms and conditions, are invalid.  Entries received after  midnight on 29/04/11 are invalid.
23.    The Promoter reserves the right to reject any entry for any reason at its sole discretion (including, without limitation, for inappropriate content) and to verify the originality of any entry.
24.    The names of the prize winners will be published by the Promoter in various forums, including (but not limited to) the website located at www.vrepublic.co.nz.
25.    The Promoter shall not be responsible if, for any reason beyond the Promoter’s control, any part of the Grand Prize, Runners Up Prizes and Special Prizes becomes unavailable.
26.    The Promoter reserves the right, in its sole discretion, to substitute any part of the Grand Prize or Runners Up Prizes with comparable prizes.
27.    The Grand Prize and the Runners Up Prizes are not transferable, exchangeable or redeemable for cash.
28.    The Promoter takes no responsibility for lost, damaged, misdirected, late, illegible or incomplete registrations or entries, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures, failures of computer equipment or software, inability to access telecommunications network services, corruption of any CD-Rom, DVD or other format holding an entry, or any other error or malfunction.
29.    The winners of the Grand Prize, Runners Up Prizes and Special Prizes agree to be available for reasonable publicity purposes without compensation including, but not limited to, photographs and interviews.  The winners acknowledge that their personal details may be published in newspapers and on the internet.
30.    Employees of the Promoter, associated agencies and their immediate families are not eligible to participate in the promotion.
31.    All entries become the property of the Promoter.
32.    Entrants agree that entries may, at the sole discretion of the Promoter, and without any charge to the Promoter, be:
(a) linked to from www.vrepublic.co.nz;
(b) hosted at www.vrepublic.co.nz;
(c) linked to or hosted on any other website for members of the public to stream;
(d) published in any medium whatsoever including DVD.
32.     Entrants must own all the copyright and other intellectual property rights in their entry (including, without limitation, all intellectual property rights in any images, music or other components of any image or footage submitted).  Entrants warrant that:
a) They own all intellectual property rights in their entry;
b) Their entry does not infringe the rights, including intellectual property rights, of any person;
c) Their entry is not subject to third party rights (including intellectual property rights and confidentiality obligations);
d) They have obtained the consent of each person appearing in, named in, described in or otherwise associated with their entry for their entry to be submitted and used by the Promoter;
e) Their entry complies with all generally held public conceptions of morality and is not offensive; and
f) Their entry does not include any material with is defamatory, unlawful, obscene, pornographic, threatening, hateful, racially or otherwise abusive or discriminative, and does not encourage dangerous or criminal activity or any activity which could result in civil liability, breach any law or regulation or which is otherwise inappropriate.
33.     Entrants agree to indemnify the Promoter, and keep the Promoter indemnified against, all claims, demands, costs (including costs on a solicitor and own client basis), losses, expenses and damages arising out of the submission of any entry and/or the use by the Promoter of any entry submitted by an entrant.
34.     To the extent permitted by law, the Promoter and its associated agencies are not liable in any way (including, without limitation, in negligence) for any loss, damage or injury (including indirect or consequential loss) suffered or sustained in connection with participation in this promotion or the use of a Prize.
35.     The Promoter reserves the right to alter any aspect of the promotion at anytime in its sole discretion.
36.     The Promoter’s decisions on all matters are final and no correspondence will be entered into.
37.     The Promoter collects and holds personal information provided with each registration and entry to be used for the purposes of the promotion and in particular to notify prize winners and to verify prize winners’ identities.  All personal information provided by entrants will be held by Frucor Beverages Limited, 86 Plunket Ave, Manukau, Auckland.  Under the Privacy Act entrants have the right to access and correct their personal information.  The Promoter will only send information regarding future promotional activities to entrants who have agreed that the Promoter may do so.
